1. The Gist

By accessing or using the CARFAXGO services (“Service”), you agree to be bound by these Terms of Service and our Privacy Policy. These terms include our Refund Policy, which is detailed within this document. If you do not agree to all of these terms, you may not use our Service.

1.1. Who’s Who

“You” refers to any individual or entity using our Services. If you use our Services on behalf of another person or entity, you represent and warrant that you are authorized to accept this Agreement on their behalf. By using our Services, you accept this Agreement for yourself and on behalf of that person or entity. If you or that person or entity violates this Agreement, you and that person or entity agree to be jointly and severally responsible to us. Your agreement is with CARFAXGO INC, Canada. These Terms govern your use of CarfaxGo.com, a product of CARFAXGO INC, Canada (“CarfaxGo”). Throughout these Terms, “CarfaxGo,” “we,” “us,” or “our” refers collectively to the CarfaxGo.com website, the product, and CARFAXGO INC, the company behind it.

2. Terms of use

2.1. Gocarfax.com Account

When using our Services requires an account, you agree to provide us with complete and accurate information and to keep that information up to date so we can communicate with you about your account. We may need to send you important updates (such as changes to our Terms of Service or Privacy Policy), or notify you of legal inquiries or complaints related to your use of our Services so you can make informed decisions in response. We may limit your access to our Services until we’re able to verify your account information, such as your email address. When you create a CarfaxGo account, we consider that an expression of interest in our products and services, which means we may contact you to share more information (e.g., educational resources). If you're not interested, you can opt out of marketing communications. You are solely responsible for all activity under your account. You are also fully responsible for maintaining the security of your account, including keeping your password secure. We are not liable for any actions or omissions by you, including any resulting damages. Do not share or misuse your login credentials, and notify us immediately of any unauthorized use of your account or other security breaches. 2.2. Terms of Service Team

All versions of the CarfaxGo Services may support team-based collaboration. The user responsible for creating and managing a team account is referred to as the Admin User. Once an Admin User has created your account, they can invite additional users to access the Services using the "invite" functionality. The Admin User must provide each invited user’s name, email address, and any other information required by CarfaxGo. An Admin User may assign additional Admin Users. Each designated Admin User will have the same permissions and responsibilities as any other Admin User, as defined by the Services and these Terms. CarfaxGo may charge fees for collaboration features or additional users added to a team account. You may not permit login sharing, time-sharing use, or any workaround that bypasses team size limits or other system controls designed to enforce licensing restrictions.

2.3. Minimum Age Requirements

You must be at least 18 years old to use our Services. If you are under 18, you may only use our Services with the consent of a parent or legal guardian who agrees to these Terms on your behalf. By using our Services, you represent and warrant that you meet this age requirement and that your parent or legal guardian has read and agrees to these Terms on your behalf.

2.4. Intellectual Property Rights

CarfaxGo provides you with a license to use the Services — it does not sell the Services to you. You acknowledge and agree that CarfaxGo Inc and its licensors retain all legal rights, titles, and interests in and to the Services, including but not limited to any ideas, concepts, inventions, systems, platforms, interfaces, tools, utilities, user interfaces, algorithms, logic, formulas, scripts, workflows, processes, software, methodologies, databases, know-how, trade secrets, and other technologies or information, as well as any intellectual property rights associated with them — whether registered or unregistered, and regardless of their geographic location. As between you and CarfaxGo, CarfaxGo retains all legal rights, titles, and interests in and to the Services and their content, excluding Your Content. CarfaxGo reserves all rights not expressly granted to you under these Terms. The rights granted to you are non-exclusive, and CarfaxGo may offer the same or similar rights to others without restriction.

3.0. Personal Information

Your use of the Services does not require the upload or inclusion of any personally identifiable information, except as outlined in this section. You hereby authorize CarfaxGo Inc to collect, use, store, and process email address(es), IP addresses from which you access the Services, and other login or authentication credentials from you and your authorized users. This is done to verify authorized access to the Services and to assist in resolving any technical or account-related issues you may encounter. This information may be considered personal data under the laws applicable in your jurisdiction. CarfaxGo will collect, use, store, and/or process this information solely for the purposes described in this section and as detailed in our Privacy Policy, which you acknowledge and accept. Unless otherwise required by applicable law, upon termination of these Terms, any personal information you provided for account creation will be deleted from our records within a reasonable period, typically within six (6) months after such termination. CarfaxGo may also collect certain data and information from you in connection with your use of the Services or in relation to these Terms. All such data will be handled in accordance with our Privacy Policy.

4.0. Fees and Payment

4.1. Fees and Payment Terms

CarfaxGo operates on a credit system. You can purchase credits to access our Services, which are non-refundable and non-transferable. All payments are processed through our third-party payment processor, Stripe, Inc. By making a purchase, you agree to be bound by Stripe's terms and policies, which can be found on their website. Refund Policy: All credit purchases are final and non-refundable. Once purchased, credits cannot be refunded, whether used or unused. Any payment disputes or chargebacks will be handled according to our payment processor's policies. You are responsible for all fees associated with your use of the Services, including any applicable taxes. CarfaxGo reserves the right to change its fees and payment terms at any time, but any changes will not affect fees already paid for credits that have been purchased. If you fail to pay any fees when due, CarfaxGo may suspend or terminate your access to the Services until payment is made in full. You are responsible for ensuring that your payment information is accurate and up to date. If your payment method fails or your account is past due, we may suspend or terminate your access to the Services until payment is received. CarfaxGo may offer promotional credits or discounts at its discretion. These promotional credits or discounts may have specific terms and conditions, including expiration dates, which will be communicated to you at the time of the offer. Promotional credits or discounts cannot be combined with other offers or discounts unless explicitly stated otherwise. CarfaxGo reserves the right to change its fees and payment terms at any time, but any changes will not affect fees already paid for credits that have been purchased.

4.2. Taxes

You are responsible for paying any applicable taxes associated with your use of the Services. CarfaxGo will not collect or remit any taxes on your behalf unless required by law. If you are required to pay any taxes, you must provide us with a valid tax exemption certificate or other documentation as required by applicable law. If we are required to collect or remit any taxes on your behalf, we will do so in accordance with applicable law.

4.3. Payment Processing

All payments for credits are processed through our third-party payment processor, Stripe, Inc. By using our Services, you agree to comply with Stripe's terms and conditions, which can be found on their website. CarfaxGo is not responsible for any errors or issues that may arise during the payment processing, including but not limited to payment failures, chargebacks, or disputes. If you encounter any issues with payment processing, please contact Stripe directly for assistance. CarfaxGo reserves the right to change its payment processing provider at any time. If we change our payment processing provider, we will notify you in advance and provide you with the necessary information to update your payment information. You are responsible for ensuring that your payment information is accurate and up to date. If your payment method fails or your account is past due, we may suspend or terminate your access to the Services until payment is received. CarfaxGo may offer promotional credits or discounts at its discretion. These promotional credits or discounts may have specific terms and conditions, including expiration dates, which will be communicated to you at the time of the offer. Promotional credits or discounts cannot be combined with other offers or discounts unless explicitly stated otherwise. 5.0. Refunds and Cancellations

All purchases of credits are final and non-refundable. Once credits are purchased, they cannot be refunded, whether used or unused. If you have any issues with your purchase, please contact our support team at sales@carfaxgo.com. If you do not agree to the Refund Policy, do not use our Services.‍

6.0. Changes to the Terms

CarfaxGo reserves the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on our website and updating the "last updated" date at the top of this page. Your continued use of the Services after any changes to the Terms constitutes your acceptance of the new Terms. If you do not agree to the changes, you must stop using the Services immediately. We may also modify or discontinue the Services, in whole or in part, at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services. If we discontinue the Services, we will provide you with a reasonable notice period to allow you to retrieve any data or information stored in your account. After the notice period, we may delete your account and any associated data or information.
